Customisation & Production Policy

Scope of Custom Production

This policy applies to all customised, personalised, or made-to-order products, including but not limited to:

  • Logo embroidery, printing, patches, labels, or trims
  • Custom colours, materials, fabrics, or constructions
  • Private label, OEM, or ODM production
  • Any product manufactured according to customer-provided specifications

Customised products are produced exclusively based on customer instructions and are not standard stock items.

Design Files & Customer Responsibility

2.1 Artwork & Specifications

Customers are responsible for providing accurate and complete design information, including but not limited to:

  • Artwork files (logo, text, graphics)
  • Colour references
  • Placement, size, and finishing requirements
  • Product specifications and quantities

By approving artwork, mock-ups, or virtual samples, the customer confirms that:

  • The design is final and ready for production
  • All content is legally owned or authorised for use

2.2 Intellectual Property (IP)

The customer warrants that all supplied designs, logos, trademarks, and artwork:

  • Do not infringe third-party intellectual property rights
  • Are authorised for commercial use

The seller shall not be liable for any IP disputes arising from customer-provided designs.

2.3 Indemnification

Customer agrees to indemnify, defend, and hold harmless Foremost Hat, its affiliates, officers, and employees from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and loss of brand reputation) arising out of or related to:

(a) Customer's breach of these Terms;

(b) any claim that the Customer-provided designs or logos infringe upon the intellectual property rights of a third party.

Samples, Mock-ups & Approval

Samples & Virtual Previews

  • Physical samples or digital mock-ups may be provided prior to bulk production
  • Samples are intended for visual and functional reference only

Sample Variations

Due to manufacturing processes, materials, and scale production, minor variations may occur between samples and bulk production, including but not limited to:

  • Colour tone differences
  • Stitch density or placement
  • Fabric texture
  • Hand-feel or finishing

Such variations are considered commercially reasonable under UK manufacturing standards and do not constitute defects.

Production Timeline

Production timelines are estimates based on current capacity and material availability

  • Delays caused by force majeure, customs issues, supply chain disruptions, or regulatory inspections are not considered contractual breaches
  • Production begins only after final design approval and payment confirmation

Order Changes & Cancellations

Before Production

Changes may be requested only before production starts and must be confirmed in writing. Additional costs or timeline adjustments may apply.

After Production Starts

Once production has commenced:

  • Orders cannot be cancelled or modified
  • This complies with UK regulations, which allow exceptions to withdrawal rights for personalised or made-to-order goods

Quality Standards & Tolerances

Industry Tolerances

Custom production is subject to industry-accepted tolerances, including:

  • Size and measurement deviations
  • Colour variation within reasonable limits
  • Minor stitching or finishing differences

Such tolerances are normal in textile and headwear manufacturing and are not considered quality defects.

Quality Inspection

Products undergo internal quality checks prior to shipment. Claims must be supported by clear photographic or documentary evidence.

Returns, Refunds & Defects (Custom Products)

Non-Returnable Nature of Custom Products

Customised or made-to-order products are non-returnable and non-refundable, except in cases of:

  • Proven manufacturing defects
  • Significant deviation from approved specifications

This aligns with UK consumer law exemptions for personalised goods.

Claims Procedure

  • Claims must be submitted within a reasonable timeframe after receipt
  • The seller may offer repair, replacement, or partial compensation depending on the situation
  • Refunds are not applicable for minor deviations within accepted tolerances

Legal & Regulatory Compliance

This policy is structured in line with key UK legal principles, including:

  • Transparency of pre-contractual information
  • Binding effect of approved designs and paid orders
  • Lawful exclusion of withdrawal rights for personalised goods
  • Fair commercial practice standards

Nothing in this policy limits mandatory rights under applicable UK law.

By placing a custom order, the customer confirms acceptance of:

  • The approved artwork and specifications
  • The non-cancellable and non-returnable nature of custom-made goods

Policy Updates

This policy may be updated to reflect:

  • Regulatory changes
  • Manufacturing process improvements
  • Operational adjustments

The latest published version shall prevail.
